Extreme climatic events : regulations formalizing certain exemptions
On 9th August 2023 the European Commission published two implementing regulations, 2023/1619 and 2023/1620, which formalise some of the derogations we proposed following the extreme weather events in Emilia-Romagna and Catalonia. Two of our member regions.
The publication of these regulations confirms AREFLH’s fundamental role in formulating legislative proposals that respond to the needs of the fruit and vegetable sector in the most difficult situations, and the value attributed to these proposals by DG AGRI and the other European institutions of reference.
Implementing Regulation 2023/1619, available in the Official Journal of the European Union, confirms the following derogations from Regulation 2013/1308 in relation to the fruit and vegetable sector:
By way of derogation from Article 33(3), fourth subparagraph, of Regulation (EU) No 1308/2013, the limit of one third of expenditure for crisis prevention and management measures under the operational programme referred to in that provision shall not apply in the year 2023 in respect of areas affected by the adverse meteorological events of the spring of 2023 to be identified by the Member States.
By way of derogation from Article 34(1) of Regulation (EU) No 1308/2013, the Union financial assistance to the operational fund referred to in that provision granted in the year 2023 to producer organisations or associations of producer organisations affected by the adverse meteorological events of the spring of 2023 to be identified by Member States shall not exceed the amount of the Union financial contribution to operational funds approved by Member States for the year 2023 and shall be limited to 60 % of the actual expenditure incurred.
Implementing Regulation 2023/1620, available in the Official Journal of the European Union, confirms the following derogations from Regulation 2021/2115 in relation to the fruit and vegetable sector:
By way of derogation from Article 50(7), first subparagraph, point (d), of Regulation (EU) 2021/2115, the limit of one third of the total expenditure for interventions within the types of intervention referred to in Article 47(2), points (f), (g) and (h), of that Regulation, shall not apply in the year 2023 in areas affected by the severe adverse meteorological events of the spring of 2023 to be identified by the Member States.
By way of derogation from Article 52(1) of Regulation (EU) 2021/2115, the Union financial assistance to the operational fund in the year 2023 of producer organisations or associations of producer organisations affected by the severe adverse meteorological event of the spring of 2023 to be identified by the Member States shall not exceed the amount of the Union financial contribution to operational funds approved by Member States for the year 2023 and shall be limited to 60 % of the actual expenditure incurred.
The entry into force of the two regulations is immediate.
